J.A.K. v. Commissioner of Public Safety

The State cancelled our client’s driver’s license, claiming that he violated the terms of the ignition interlock program by providing a breath sample that had alcohol in it. He was looking at being forced to restart the program, but instead he hired us – and we immediately demanded complete copies of the logs for all of his breath tests. Review of the logs showed that someone else, not our client, provided the positive breath sample, and we used that information to get our client’s cancellation reversed.
