State v. E.H.

Our client was arrested and charged with Domestic Assault out of Mille Lacs County. Our client had everything riding on a complete victory. Unless he won, he would likely be thrown out of the country due to the severity of the charges. The state refused to dismiss the case and we went to trial.

To increase our odds of success we waived a jury. Although he was here legally, our client was a "resident alien" with a green card and spoke primarily Spanish. Our research indicated an unbiased court would be much less likely to consider his ethnicity than the potential jury venire.

It worked. At the end of the trial our client was acquitted - not guilty!
