Minnesota's DWI Test Refusal Law in Review: Why the Crime of Test Refusal is Currently Considered Constitutional

In 2009, the Minnesota Supreme Court upheld the DWI test refusal law in the case of State v. Netland 762 N.W.2d 202 (Minn.2009). In doing so, the court placed all its emphasis on the "fact" that alcohol in a driver's bloodstream "rapidly" and "naturally" dissipates, reasoning that law enforcement would never have enough time to obtain a warrant for a blood, breath, or urine test before the evidence of alcohol consumption was destroyed. In July we blogged about two public defenders who exposed serious scientific flaws at the St. Paul Crime Laboratory. Christine Funk and Laurie Traub elicited testimony at a pre-trial hearing revealing widespread problems at the lab, including poor documentation of testing procedures, lack of standard operating procedures and contamination of evidence. Several counties agreed not to use the drug test results from the lab, but stopped short of admitting the results were unreliable. Read More
