T.A.W. v. Commissioner of Public Safety
The State revoked our client’s driver’s license after arresting him for DWI, and had him submit to a breath test. After hours of reviewing all of the video recordings we discovered an interesting issue: the officer did not administer the breath test pursuant to his training and the Bureau of Criminal Apprehension’s standards, by failing to conduct a proper pre-test observation period. We took the issue to court, and after a lengthy hearing, the judge agreed with our arguments and our client's license revocation was rescinded.
